Terms of Service

These Terms of Service (“Terms”) are the rules for using Japanese with Yosuke Sensei (https://yosukesensei.com) (the “Service”). In these Terms, “we”, “us” and “our” mean the operator of the Service, and “you” means anyone who uses the Service. Please read and agree to these Terms before using the Service.

Article 1 (Scope)

  1. These Terms apply to all matters between you and us relating to the use of the Service.
  2. Our Privacy Policy and Commercial Disclosure are part of these Terms. We handle your personal information according to our Privacy Policy.
  3. If you are under 18, please use the Service with the consent of a parent or guardian.

Article 2 (Registration)

  1. You can register with an email address and password, or with your Google account.
  2. Please register with accurate information, and update it promptly if it changes.
  3. Each person may have only one account.
  4. We may refuse a registration that we consider inappropriate, for example from someone who has broken these Terms before.

Article 3 (Membership types)

The Service has the following membership types. The lessons you can read depend on your membership type.

  • Free: a free membership. You become a Free member when you register.
  • Premium: a paid monthly membership that gives you access to all lessons.
  • Special: a free membership for students who are currently taking Japanese lessons with us. We assign this membership, and we change it to Free when the lessons end.

Article 4 (Your account)

  1. You are responsible for keeping your password and other login details safe.
  2. You may not share your account with anyone else, or transfer or lend it to anyone.
  3. Any use of the Service with your login details is treated as your own use, unless it results from our intentional act or negligence.
  4. If you notice that your login details have been stolen or that someone else is using your account, please contact us right away.

Article 5 (Fees and payment)

  1. Premium membership costs US$3.99 per month (tax included).
  2. Payment is made by credit card through Stripe. You are charged when you sign up, and then automatically once a month.
  3. Premium membership renews automatically every month until you cancel.
  4. If we change the price, we will announce it on the Service in advance.
  5. If we cannot confirm your payment, for example because your card has expired, we may stop your Premium access.

Article 6 (Cancellation and refunds)

  1. You can cancel your Premium membership at any time from the Membership Account page after logging in.
  2. After you cancel, you will not be charged again. You will keep full access until the end of the period you have already paid for, and then your account will switch to the Free plan automatically.
  3. We are sorry, but we cannot offer refunds once a payment has been made. However, if a problem on our side keeps you from accessing the lessons and we are unable to fix it, we will refund that month’s fee.

Article 7 (Deleting your account)

  1. If you would like to delete your account, please email us at hello@yosukesensei.com.
  2. If you are a Premium member, please cancel your membership first. Once your account is deleted, you can no longer read the lessons, even if part of your paid period remains.

Article 8 (Copyright)

  1. The copyright in all content on the Service, including articles, images, audio and PDFs, belongs to us or to the rightful owners.
  2. You may use the content only for your own Japanese study. You may not copy, republish, distribute, sell or modify it without our permission.

Article 9 (Prohibited actions)

When using the Service, you must not:

  • break any law or act against public order and good morals
  • do anything connected with crime
  • share your account, or transfer or lend it to anyone
  • copy, republish, distribute or sell content from the Service without our permission
  • make paid lessons available to people who are not members
  • collect content from the Service with automated tools, or use it to train AI
  • put an excessive load on our servers or network, or interfere with the running of the Service
  • access the Service without authorization, or use another member’s account
  • insult or harass other members, other people or us, or violate anyone’s rights
  • register with false information
  • do anything else that we consider inappropriate

Article 10 (Suspension and account removal)

We may suspend your use of the Service or remove your account without notice if any of the following applies:

  • you break these Terms
  • your registration contains false information
  • we cannot confirm your payment
  • we otherwise consider your use of the Service inappropriate

If we suspend your use or remove your account because you broke these Terms, we will not refund any fees you have paid.

Article 11 (Changes, interruptions and ending the Service)

  1. We may change the content of the Service, for example by adding, updating or removing lessons.
  2. We may interrupt the Service temporarily without notice for server maintenance, system problems, power outages, natural disasters or similar reasons.
  3. We may end the Service. If we do, we will announce it on the Service at least one month in advance and stop all Premium renewals.

Article 12 (Disclaimer and limitation of liability)

  1. We do our best to keep the content accurate, but we do not guarantee its accuracy or usefulness, or any learning results such as improving your Japanese or passing an exam.
  2. Except in cases of our intentional misconduct or gross negligence, we are not liable for any damage you suffer in connection with the Service. However, this paragraph does not apply if the contract between you and us is a consumer contract under Japan’s Consumer Contract Act.
  3. Even in that case, if you suffer damage because of our negligence (excluding gross negligence), our liability is limited to the amount you paid us in the month in which the damage occurred.

Article 13 (Changes to these Terms)

  1. We may change these Terms when necessary.
  2. When we change these Terms, we will announce the new content and the date it takes effect on the Service in advance.
  3. If you use the Service on or after the date the changes take effect, you will be considered to have agreed to the new Terms.

Article 14 (Notices)

We will contact you by email to your registered address, or by posting on the Service.

Article 15 (Language)

These Terms are provided in English and Japanese. If there is any difference between the two versions, the Japanese version prevails.

Article 16 (Governing law and jurisdiction)

  1. These Terms are governed by the laws of Japan.
  2. The court with jurisdiction over the operator’s address will have exclusive jurisdiction, as the court of first instance, over any dispute relating to the Service.

利用規約

本規約は、「Japanese with Yosuke Sensei」（https://yosukesensei.com、以下「本サービス」といいます）の運営者（以下「運営者」といいます）が定める、本サービスの利用条件です。本サービスをご利用になる方（以下「利用者」といいます）は、本規約に同意したうえでご利用ください。

第1条（適用）

  1. 本規約は、本サービスの利用に関わる、利用者と運営者との間のすべての関係に適用されます。
  2. プライバシーポリシーと特定商取引法に基づく表記は、本規約の一部を構成します。利用者の個人情報は、プライバシーポリシーに従って取り扱います。
  3. 18歳未満の方は、親権者の同意を得たうえで、本サービスをご利用ください。

第2条（会員登録）

  1. 会員登録は、メールアドレスとパスワード、または Google アカウントで行うことができます。
  2. 利用者は、正確な情報で登録し、登録内容に変更があったときは、すみやかに変更するものとします。
  3. アカウントは、1人につき1つとします。
  4. 運営者は、過去に本規約に違反したことがある方など、運営者が不適切と判断した方の登録をお断りすることがあります。

第3条（会員の種類）

本サービスには、次の会員の種類があります。会員の種類によって、お読みいただける記事が異なります。

  • Free 会員：無料の会員です。会員登録をすると、Free 会員になります。
  • Premium 会員：月額料金をお支払いいただく会員です。本サービスのすべての記事をお読みいただけます。
  • Special 会員：運営者の日本語レッスンを受講している方のための、無料の会員です。運営者が登録し、レッスンの受講が終わったときは、運営者が Free 会員に変更します。

第4条（アカウントの管理）

  1. 利用者は、自己の責任において、パスワードなどのログイン情報を管理するものとします。
  2. 利用者は、アカウントを第三者と共有したり、譲渡・貸与したりしてはなりません。
  3. 利用者のログイン情報を使って行われた本サービスの利用は、その利用者本人による利用とみなします。ただし、運営者の故意または過失による場合は、この限りではありません。
  4. ログイン情報が盗まれたり、第三者に使われたりしたことに気づいたときは、すみやかに運営者にご連絡ください。

第5条（料金と支払い）

  1. Premium 会員の料金は、月額 3.99 米ドル（税込）です。
  2. 料金は、クレジットカード（Stripe による決済）でお支払いいただきます。初回はお申し込みの際に、その後は1か月ごとに自動でご請求いたします。
  3. Premium 会員は、解約の手続きをされるまで、1か月ごとに自動で更新されます。
  4. 料金を変更するときは、事前に本サービス上でお知らせします。
  5. カードの有効期限切れなどにより、お支払いが確認できないときは、Premium 会員の利用を停止することがあります。

第6条（解約と返金）

  1. Premium 会員は、ログイン後、Membership Account のページから、いつでも解約できます。
  2. 解約後に料金が請求されることはございません。お支払い済みの期間が終わるまでは、引き続きすべての記事をお読みいただけます。その後は、自動で Free 会員に切り替わります。
  3. お支払い後の返金はいたしかねます。ただし、本サービスの不具合により記事をお読みいただけず、解決できない場合は、その月の料金を返金いたします。

第7条（退会）

  1. 退会（アカウントの削除）をご希望の場合は、hello@yosukesensei.com までご連絡ください。
  2. Premium 会員の方は、先に解約の手続きをしてください。退会されると、お支払い済みの期間が残っていても、記事をお読みいただけなくなります。

第8条（著作権）

  1. 本サービスの記事、画像、音声、PDF などの内容に関する著作権は、運営者または正当な権利を持つ第三者に帰属します。
  2. 利用者は、本サービスの内容を、ご自身の日本語の学習のためにのみ利用できます。運営者の許可なく、複製、転載、配布、販売、改変などをしてはなりません。

第9条（禁止事項）

利用者は、本サービスの利用にあたり、次の行為をしてはなりません。

  • 法令または公序良俗に違反する行為
  • 犯罪行為に関連する行為
  • アカウントを第三者と共有したり、譲渡・貸与したりする行為
  • 本サービスの内容を、運営者の許可なく複製、転載、配布、販売する行為
  • 有料の記事の内容を、会員以外の方が読める状態にする行為
  • 自動化されたツールで本サービスの内容を取得する行為や、AI の学習に利用する行為
  • 本サービスのサーバーやネットワークに過度の負担をかける行為や、運営を妨げる行為
  • 不正アクセスや、他の利用者のアカウントを使う行為
  • 他の利用者、第三者または運営者を誹謗中傷したり、その権利を侵害したりする行為
  • 虚偽の情報で登録する行為
  • その他、運営者が不適切と判断する行為

第10条（利用の停止・登録の削除）

運営者は、利用者が次のいずれかに当たるときは、事前に通知することなく、本サービスの利用を停止したり、登録を削除したりすることがあります。

  • 本規約に違反したとき
  • 登録内容に虚偽があったとき
  • 料金のお支払いが確認できないとき
  • その他、運営者が本サービスの利用を適当でないと判断したとき

本規約への違反により利用を停止したり、登録を削除したりした場合、お支払い済みの料金は返金いたしません。

第11条（サービスの変更・中断・終了）

  1. 運営者は、記事の追加・変更・削除など、本サービスの内容を変更することがあります。
  2. 運営者は、サーバーの保守、システムの故障、停電、天災などのため、事前に通知することなく、本サービスを一時的に中断することがあります。
  3. 運営者は、本サービスを終了することがあります。その場合は、1か月前までに本サービス上でお知らせし、Premium 会員の自動更新を停止します。

第12条（保証の否認・免責）

  1. 運営者は、本サービスの内容が正確であるよう努めますが、その正確性や有用性、日本語力の向上や試験の合格などの学習効果を保証するものではありません。
  2. 運営者は、運営者の故意または重大な過失による場合を除き、本サービスに関して利用者に生じた損害について、責任を負いません。ただし、本サービスに関する運営者と利用者との間の契約が消費者契約法に定める消費者契約に当たる場合、この項は適用しません。
  3. 前項ただし書の場合であっても、運営者の過失（重大な過失を除きます）により利用者に生じた損害の賠償は、その損害が生じた月に利用者が運営者に支払った料金の額を上限とします。

第13条（本規約の変更）

  1. 運営者は、必要に応じて本規約を変更することがあります。
  2. 本規約を変更するときは、変更後の内容と、その効力が生じる日を、事前に本サービス上でお知らせします。
  3. 効力が生じる日以降に本サービスを利用された場合、利用者は変更後の規約に同意したものとみなします。

第14条（連絡・通知）

運営者から利用者へのご連絡は、登録されたメールアドレスへのメール、または本サービス上での掲示によって行います。

第15条（言語）

本規約には日本語版と英語版があります。両者の内容に違いがある場合は、日本語版が優先します。

第16条（準拠法・管轄裁判所）

  1. 本規約は、日本法に従って解釈されます。
  2. 本サービスに関して紛争が生じた場合は、運営者の住所地を管轄する裁判所を、第一審の専属的合意管轄裁判所とします。
